In 2005 Judge Aviva K. Bobb illegally re-opened an already settled conservatorship case by not following the provisions of the legally
binding settlement so ordered by her predecessor, Honorable Thomas W. Stoever. The provisions protected 87 year-old blind,
Alzheimers victim, Lee Peters, from her own offspring who wanted to :
-
institutionalize Lee Peters against her will;
- sell her house while
the real estate market was high;
- set aside $100,000 for Lee Peters'
institutionalization;
- and divide the remainder amongst themselves.
Lee
Peters' property was valued at $600,000 in 2003 and $1 million in 2004.
Instead of protecting the vulnerable senior, Judge Bobb:
- threatened blind, demented 86 year old Lee Peters with arrest and jail if her son and long time caregiver
did not bring her to court for institutionalization;
- illegally removed Lee Peters
from her home of nearly 50 years and from her long time familial caregivers,
son,
Casey and daughter-in-law, Marilyn Peters;
- appointed known elder abusers as Lee
Peters' co-conservators, the very people Lee Peters needed
protection
from, who had a financial interest in the death of Lee Peters;
- denied
Lee Peters vital medical care which directly resulted in her death;
- carved up Lee
Peters' estate and awarded large fees to corrupt lawyers and rogue conservators who
had
worked against Lee Peters and whose handiwork caused her demise.
On February 8, 2006 Judge Bobb threatened to leave the courtroom
when Casey Peters (In Pro Per) attempted to show medical evidence that Lee Peters was diagnosed with Alzheimers disease and neurological
blindness 18 months prior to signing complex legal documents that created The Lee Peters Trust and empowered Nora Hamill (lawyer) and
Kathryn Pruessner Peters (lawyer), two women Lee Peters disliked and did not trust when she was of sound mind.
When Casey
Peters showed documented evidence that self appointed trustees had committed crimes of malfeasance, fraud, perjury, forgery,
theft of Social Security and grand theft real estate because Nora Hamill and Kathryn Pruessner Peters had:
- used forgery to gain $10,000 from Lee Peters' IRA which they illegally placed into the trust and used to
pay their own lawyers in their fight against Lee Peters;
-
stolen many thousands of dollars from Lee Peters life savings, under the guise of the fraudulent Lee
Peters Trust;
- withheld Lee Peters Social Security benefits for many months
in 2004 in their attempts of starving
Lee from her home;
- illegally removed Lee Peters name from the title of her house, granting themselves the million dollar
property, for which they paid no money;
corrupt probate attorney, John T. Rogers Jr. suddenly realized those he had colluded with
(the money controllers) were in fact, criminals. Instead of protecting his client and reporting the criminals to the
District Attorney's Office for prosecution, John T. Rogers Jr. resigned and cowered away from the case.
When Casey Peters pointed
out that it is against Federal law to place an IRA into a trust, Judge Bobb declared "I don't care about Federal law, this is a State
law court". Bobb then approved the accounting.
Judge Bobb allowed the parties hostile towards Lee Peters to loot her estate
and pay huge fees to the lawyers who worked against Lee Peters, causing her demise. Bobb allowed one lawyer, Jeffrey L. Condon
to be paid twice and another lawyer, Victoria Velarde to be paid for the defense of 4 individuals from 2 unrelated civil cases to
be paid from Lee Peters' estate. Bobb awarded these fees during a hearing on the Conservatorship when the Trust was not before
her and when trust beneficiaries had not been notified:
- $75,000 to John T. Rogers
after he malpracticed against his court appointed client, Lee Peters;
- $30,000 to
Frumeh Labow, who was appointed conservator by Bobb in direct violation of the court
ordered settlement signed by all parties and their attorneys and ordered by Judge Stoever;
-
$70,000 to Weinstock, Manion (lawyers for Frumeh Labow);
- $40,000 to Hinojosa and
Wallet (lawyers for Nora Hamill and Kathryn Pruessner Peters);
- $30,000 to Dennis
Block (lawyers for Nora Hamill and Kathryn Pruessner Peters);
- $67,000 to Jeffrey
L. Condon (lawyer for Nora Hamill and Kathryn Pruessner Peters);
- $67,000 to Jeffrey
L. Condon (lawyer for Nora Hamill and Kathryn Pruessner Peters) was paid twice;
-
$40,000 to Victoria Velarde (lawyer for Nora Hamill and Kathryn Pruessner Peters who denied
Lee Peters vital
medical care, causing her death);
- $37,000 to Victoria Velarde for the defense of
4 individuals in 2 unrelated civil cases.
No fee was awarded to Linda Paquette, the neutral investigative attorney whom Judge
Bobb appointed, whose findings and recommendations Judge Bobb called for and then completely disregarded. Ms. Paquette
conducted a thorough investigation of Lee Peters' situation and her recommendations would have protected Lee from the predators
who wanted her demise and who were after her estate.
Judge Bobb ruled against the investigative attorney. Lee Peters
died as a result.
Judge Aviva K. Bobb obstructed justice to blind, demented, 88 year old Lee Peters; denied Lee Peters
vital medical care which resulted directly in her death and has allowed the looting of Lee Peters' previously unencumbered
million dollar estate.
